1. This Holiday Escape Promotion (“Promotion”) is organised by SIMON & SCHUSTER (UK) LIMITED of 222 Gray’s Inn Road, London WCIX 8HB (“Promoter”). Promoter reserves the right to cancel or amend the Promotion or these Official Rules without notice at any time, including, without limitation, in the event of an act of God or any other event outside of Promoter’s reasonable control. Promoter shall notify all entrants of any such cancellation or amendment. Promoter, its parent company, subsidiaries and affiliates, and any other companies or agencies associated with the Promotion (such as technology, advertising, promotion, fulfillment, or judging partners), will hereinafter collectively be referred to as the “Promotion Entities.”
2. Only one entry per person/e-mail is permitted. Promoter reserves the right to disqualify any entrant who uses multiple accounts, telephone numbers, e-mail addresses, or any technologies which permit multiple entries and any entries which are completed by third parties or in bulk, illegible, have been altered, reconstructed, forged, or tampered with or are incomplete.
3. Each entrant must be a resident of the United Kingdom and aged 18 or over. Promoter may require proof that you are eligible to enter the Promotion. Employees of Promoter or affiliated companies, employees of agents or suppliers of the Promoter or affiliated companies, their immediate families or anyone professionally associated with this Promotion or its administration and their immediate families, are excluded from entry.
4. Any entrants that do not meet the criteria to enter the Promotion shall be disqualified. Promoter also reserves the right to remove any entries from the Promotion it determines, in its sole discretion, to be in violation of these Official Rules or if the entrant’s conduct is contrary to the spirit or intention of the Promotion.
5. To enter, entrants must complete the online entry form via https://www.simonandschuster.co.uk/p/the-holiday-escape-on-the-beach-comp. No purchase is necessary and there is no charge to enter.
6. By submitting your entry form, you:
• consent to the Promoter publishing your picture on the Promoter’s and affiliated companies’ and other third-party websites, on social media and all other platforms;
• acknowledge that both the Promoter will use and store your personal data details as independent Data Controllers for the purpose of fulfilling this Promotion. Information will be held in accordance with the Promoter’s Privacy Policy in place from time to time (see https://www.simonandschuster.com/p/privacy-policy)
• consent to the Promoter publishing and/or disclosing your name, county, and a copy of your entry form if you win a prize;
• hereby grant to Promoter a worldwide, irrevocable, royalty free, perpetual licence to publish any or all of the content of your entry (including the entry and photographs, although publication does not necessarily mean the entrant has won a prize).
The Promoter is not obliged to publish the content) submitted to the Promoter to edit, use modify, copy, publish, display, promote, publicise and use in any and all media (including print, online and social media) for publicity, news and/or marketing purposes, along with your image, likeness and voice (where any video or audio recording is provided).
7. The Promoter is not obliged to publish your picture or the content you submit.
8. Promotion Period for receipt of entries starts at 12:00:00 AM Greenwich Mean Time (“GMT”) on 25th April 2024 (“Opening Date”) and ends at 23:59:59 PM GMT on 31st July 2024 (“Closing Date”). Entries submitted after the Closing Date will be invalid.
9. Promoter accepts no responsibility for any late, lost, or misdirected entries regardless of cause including but not limited to messages not received due to technical disruptions, network congestion, loss in service of online entry mechanisms, computer error in transit or any other reason. Promoter cannot enter into correspondence with entrants who experience difficulties with entering online. Promoter will not accept proof of transmission or submission or any other evidence as proof of entry to the Promotion.
10. The prize is: One (1) Grand Prize winner will receive one holiday voucher to the value of £2,500 (that comprises of a flight and hotel) made with www.onthebeach.co.uk to be redeemed before 30/09/24 and travel completed within 12 months of booking.
Total ARV of Grand Prize is: £2,500.00
The prize is a holiday voucher which is redeemable against any package holiday (that includes flight and accommodation) which is advertised on the Co-Promoter’s website www.onthebeach.co.uk.
The prize can be redeemed against a holiday of any duration, any board type and to any destination which is advertised on the Co-Promoter’s website (www.onthebeach.co.uk). flying from a UK airport and on leading room types, provided that such holiday includes both a flight and accommodation. The prize cannot be redeemed against flight only or hotel only bookings.
The prize must be booked by 30/09/24 and travel completed within 12 months of booking. If the prize has not been booked, taken up and concluded by this date, the prize shall be deemed forfeited. No extension is possible.
At least one member of the travelling party must be aged over 18 or over.
The prize has a maximum value of £2,500 only. Any cost above this amount is the responsibility of the winner of the prize and must be paid in full at the time of booking. No alternative payment plan or method shall be available to a winner in any circumstance.
The prize does not include travel insurance, spending money, any amounts payable locally such as resort fees, tourist and/or other taxes, ancillaries such as seat reservations and baggage and any other items or expenses not listed in the prize description. The winner and their travelling party are responsible for charges that apply for any food, beverages or services outside of their chosen board basis plans. All such costs and expenses will be the responsibility of the winner and members of their travelling party.
The prize does not include transfers in the UK to or from the chosen UK airport. The winner and their travelling party are responsible for arranging and paying for transfers to and from the chosen UK airport.
The winner and their travelling party are responsible for ensuring they hold a valid passport and any necessary visa to travel, hold all adequate travel insurance policies, and comply with any other terms and conditions applicable to the prize.
Any booking made to redeem the prize is subject to OTB’s separate terms of business, and the terms and conditions of the suppliers of the flights and accommodation. Copies of these terms can be found on OTB’s website (www.onthebeach.co.uk/terms_of_business).
Any optional purchases or supplements are subject to the Co-Promoter’s terms and conditions. Any changes made after the booking has been processed are subject to amendment fees.
It is the responsibility of each winner to inform the Co-Promoter of any wheelchair or similar access requirements for the winner and/or their travelling party when taking up the prize, and to adhere to any applicable health and safety guidelines.
Once OTB has been informed of the winner by the Promoter of the competition, the winner must contact us via winners@onthebeach.co.uk to claim their prize. The prize cannot be redeemed online, it can only be redeemed through making a booking with Co-Promoter by telephone.
Any fees or costs associated with or incidental to the acceptance or use of the prize (other than delivery of the same in accordance with these terms) will be the responsibility of the winner.
The prize is subject to availability at the required travel date. The prize is non-exchangeable, non-transferable and has no cash value. No cash equivalent will be given. No refunds will be given in the event the winner cancels the holiday or is unable to travel.
11. The winners shall be notified via email on or around 7th August 2024 and must respond accepting the prize via email within seven (7) calendar days of receipt of the foregoing notification email from Promoter. If a selected winner does not confirm the prize via email within seven (7) calendar days of the notification email being sent by Promoter, Promoter may select another winner. Any winner that is not qualified to enter the Promotion shall be disqualified. Promoter will not accept any amended contact details provided after the Promotion entry has been summitted. Promoter is not liable for any inability to contact any entrant whether due to errors, omissions or inaccuracies in the contact details provided by an entrant on an entry form or due to technical problems preventing Promoter from obtaining accurate contact details, including, without limitation, any acts, or omissions by any third-party service provider or for any other reason.
12. The prize is non-transferable, no money alternative is available, and no part of the prize may be substituted for other benefits, items, or additions. Promoter does not accept any responsibility if you are not able to claim the prize and the prize may not be claimed by a third party on your behalf. The prize not valid with other offers. Prizes are subject to availability. Promoter reserves the right to substitute the prize with a prize of equal or greater value. The prize is not negotiable or transferable.
13. By entering the Promotion all entrants:
- waive all moral rights in the entry and all content provided including photographs; and
- undertake to Promoter that all such materials including photographs are not and do not represent a breach of any third-party intellectual property rights and will not contain anything which is defamatory, indecent, harassing or threatening and that they will indemnify the Promotor for any loss, damage or liability which arises out of any breach of this clause; and
- assign to the Promoter all rights (including present and future copyright) in their entry (but not the copyright in any photographs) and all associated materials.
14. For the avoidance of doubt, all rights in the name and title of the Promotion and the format rights for the Promotion are the property of Promoter and the same may be exploited at their absolute discretion.
15. Promotor shall have no liability for any losses or damages which may be suffered by an entrant (or any person claiming under or through the entrant), in connection with this Promotion, whether the same are suffered directly or indirectly or are immediate or consequential, and whether the same arise in contract, tort (including negligence) or otherwise howsoever, but Promotor does not exclude liability for:
- death or personal injury caused by the negligence of Promotor
- fraud or fraudulent misrepresentation; or
- any other liability which cannot be excluded by law.
16. Duplicate Entries by the same person will be subject to disqualification. Any other attempted form of Entry is prohibited. No automatic, programmed; robotic or similar means of Entry are permitted. All Entries become the sole and exclusive property of the Promoter. Delivery of prizes requires a street address. Only fully completed Entry forms are eligible. Receipt of Entries will not be acknowledged or returned. The Promotion Entities are not responsible for: (i) technical, hardware, software, telephone or other communications malfunctions, errors or failures of any kind; (ii) lost or unavailable network connections, web site, Internet, or ISP availability, unauthorized human intervention, traffic congestion, incomplete or inaccurate capture of Entry information (regardless of cause); (iii) lost, late, illegible, stolen, invalid, unintelligible, misdirected, failed, incomplete, technically corrupt or garbled Entry, which will be disqualified; (iv) jumbled or delayed computer transmissions which may limit one’s ability to enter the Promotion; (v) any injury or damage to participant’s or any other person’s computer relating to or resulting from participating in this Promotion or downloading any materials in this Promotion; (vi) or for problems of any other kind whether mechanical, human, or electronic. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Each potential winner may be required to show proof of being the authorized account holder.
17. No forbearance or delay by either party in enforcing its rights shall prejudice or restrict the rights of that party, and no waiver of any such rights or of any breach of any contractual terms shall be deemed to be a waiver of any other right or of any later breach. If any provision of these Official Rules is judged to be illegal or unenforceable, the continuation in full force and effect of the remainder of the provisions will not be prejudiced. None of these Official Rules are intended to confer a benefit on, or to be enforceable by, any person other than the entrant or Promotor.
18. These Official Rules and any non-contractual obligations arising out of or in connection with these Official Rules for the Promotion will be governed by English law. The courts of England shall have exclusive jurisdiction to determine any dispute arising out of or in connection with these Official Rules for the Promotion.

By entering into this Promotion, you agree to be bound by these Official Rules(and by any other requirements or limitations set forth in promotional materials relating to this Promotion) which may be amended or varied at any time by Promoter.
20. Promoter must either publish or make available information that indicates that a valid award took place. To comply with this obligation Promoter will send the surname and county of prize winners and, if applicable, copies of their winning entries, to anyone who emails Amy.Fulwood@simonandschuster.co.uk within one month after the closing date of the Promotion.
21. If you object to any or all of your surname, county and winning entry being published or made available, please contact Promoter by emailing Amy.Fulwood@simonandschuster.co.uk. In such circumstances, Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.
22. If there is any reason to believe that there has been a breach of these terms and conditions, Promoter may, at its sole discretion, reserve the right to exclude you from participating in the Promotion.
